These Terms of Sale (“Terms”) govern purchases from the SwimBuy OÜ online store at https://swimbuy.ee (the “Store”). By placing an order, the buyer confirms that they have read and agree to these Terms. The Terms are the main contractual terms of purchase. The “Returns Policy” (Tagastuspoliitika) page is a short practical guide to returns. If there is a conflict between the Returns Policy and these Terms, the law and these Terms prevail.

2. Scope of the Terms
 2.1. These Terms apply to all purchases from the Store unless otherwise agreed in writing (including by email).
 2.2. The Store is primarily intended for consumers. If the buyer is a legal entity, the Terms apply to the extent permitted by law.
 2.3. The primary language of the Terms is Estonian. If the buyer uses the Store in Russian or English, the seller may also provide information in that language; in case of a dispute, the Estonian version prevails unless otherwise required by law.

3. Products and availability
 3.1. Product descriptions, photos and prices in the Store are informative. Photos are illustrative; minor differences (e.g. colour on screen) may occur.
 3.2. Placing an order is the buyer’s offer to purchase the selected product(s) at the price shown in the Store.
 3.3. If an ordered product cannot be supplied (e.g. stock change or supply disruption), the seller will notify the buyer by email. The buyer may then cancel the order and receive a refund of any amount already paid, or agree to a replacement product.

4. Prices
 4.1. Product prices are in euros and shown on the product page in the Store.
 4.2. A delivery fee may be added under section 6, unless delivery is free.
 4.3. If there is an obvious pricing error in the Store (e.g. a technical fault or clear typo), the seller may cancel the order before dispatch. Any amount already paid will be refunded.

5. Ordering and Payment

5.1. The buyer places an order in the Store, confirms the order details, and accepts these Terms.

5.2. Payments are processed securely through MakeCommerce (Maksekeskus AS). The available payment methods are displayed during checkout and may include online bank payments and other payment methods offered by the payment service provider.

5.3. After confirming the order, the buyer is redirected to the secure MakeCommerce payment environment to complete the payment.

5.4. The purchase agreement enters into force once the payment has been successfully completed and confirmed by the payment service provider.

5.5. After successful payment, the seller sends the buyer an order confirmation by email and begins processing the order.

5.6. The seller keeps the buyer informed about the status of the order and its delivery within a reasonable time.


6. Delivery
 6.1. Delivery method: parcel locker in Estonia.
 6.2. Delivery price:
  - €3.49 per order; or
  - free when the product total (excluding delivery) is at least €39.00.
 6.3. Estimated delivery time: 1–3 business days after payment is received, if the item is in stock and nothing else is stated. This is an estimate, not a guaranteed date.
 6.4. Orders are currently delivered within Estonia. For delivery abroad, contact us by email before ordering.
 6.5. The buyer is responsible for providing a correct delivery address / parcel locker choice and contact details. Costs or delays caused by incorrect details are borne by the buyer, unless the error is the seller’s.
 6.6. After the parcel is handed over to the courier / locker operator, further delivery follows the operator’s terms (including locker storage time). The buyer is usually notified by SMS or email when the operator provides that service.

7. Right of withdrawal for distance contracts (14 days)
 7.1. A consumer buyer may withdraw from a distance contract within 14 days of receiving the goods, without giving a reason, in accordance with the Law of Obligations Act.
 7.2. To exercise the right of withdrawal, the buyer must send a clear statement to info@swimbuy.ee before the 14-day period ends. Include the order number, your name, and that you wish to withdraw from the contract.
 7.3. Returned goods must be unused, complete and in a saleable condition. If goods have been opened or used in a way that significantly reduces their value, the seller may reduce the refund or limit the withdrawal right to the extent allowed by law.
 7.4. Hygiene products and other goods that cannot be returned after opening for health or hygiene reasons may be excluded from the withdrawal right where the law allows. Where such a limit applies to a specific product, it will be indicated on the product page if possible, or the buyer will be informed during the order process.
 7.5. The buyer must return the goods without undue delay and no later than 14 days after giving notice of withdrawal. Direct return costs are borne by the buyer, unless otherwise agreed with the seller or the goods are defective.
 7.6. The seller refunds amounts paid (including standard delivery cost if the entire order is returned) without undue delay and no later than 14 days after receiving the withdrawal notice. The seller may withhold the refund until the goods are received or the buyer provides proof of return shipment. Refunds are made to the same account used for payment unless otherwise agreed.

8. Returns and exchanges
 8.1. In addition to the statutory right of withdrawal, the buyer may request a return or an exchange (including for another size, colour or product) by emailing info@swimbuy.ee. An exchange is possible remotely by agreement with the seller. The method of exchange (e.g. sending a replacement after the returned goods are received, simultaneous shipment, or settling any price difference) is agreed by email. Until an agreement is reached, the usual return conditions apply.
 8.2. If goods are defective (e.g. transport damage, wrong item), the seller bears reasonable return costs. Please contact us by email first, including the order number, a description of the issue and photos if possible.
 8.3. A short practical guide to return steps is on the “Returns Policy” page (https://swimbuy.ee/returns-policy). The legal terms on withdrawal, returns, exchanges and complaints are set out in these Terms (sections 7–9). If there is a conflict, the law and these Terms prevail.

9. Complaints and non-conformity
 9.1. The buyer may submit a complaint if goods do not conform to the contract (e.g. a defect, wrong item).
 9.2. Send complaints to info@swimbuy.ee. Include the order number, a description of the issue and photos if possible.
 9.3. The seller will reply within a reasonable time (usually within 15 days) and offer a remedy required by law (e.g. repair, replacement or refund), depending on the circumstances.
 9.4. Any separate manufacturer warranty does not limit the buyer’s statutory rights.

10. Liability
 10.1. The seller is liable for failure to perform or improper performance of obligations under Estonian law.
 10.2. The seller is not liable for delays or losses caused by circumstances beyond reasonable control (e.g. courier disruptions after handover to the operator, natural disasters, power outages), unless otherwise required by law.
 10.3. The buyer is responsible for the accuracy of the information they provide.

11. Personal data
 11.1. The seller processes personal data to fulfil orders, communicate with customers and meet legal obligations.

12. Dispute resolution
 12.1. We aim to resolve disputes amicably. Send written complaints to info@swimbuy.ee.
 12.2. If no agreement is reached, a consumer may contact the Consumer Protection and Technical Regulatory Authority (Tarbijakaitse ja Tehnilise Järelevalve Amet), the Consumer Disputes Committee, or a court.

 12.4. These Terms are governed by the law of the Republic of Estonia. Jurisdiction is determined by law.

13. Changes to the Terms
 13.1. The seller may update these Terms. The new version is published in the Store with its effective date.
 13.2. An order is governed by the Terms in force when that order was placed.

Returns Policy

If there is a conflict, the law and the Terms of Sale apply.

1. 14-day right of withdrawal
 If you buy as a consumer, you may withdraw from an online purchase within 14 days of receiving the goods, without giving a reason.

 Include: your order number, name, and that you wish to return the goods / withdraw from the contract.

3. Condition of returned goods
 Returned goods must be:
  - unused and in saleable condition
  - complete (including accessories that were part of the set)
  - free of signs of use, damage or alteration
 You may inspect products as you would in a physical store (to understand their nature and characteristics). If an item has been used beyond reasonable inspection, we may reduce the refund to the extent allowed by law.
 Hygiene accessories (e.g. earplugs, nose clips and similar items) opened after delivery may not be returnable.

4. Exchanges
 An exchange (e.g. for another size, colour or product) is possible remotely if we agree by email.
 Email info@swimbuy.ee and describe what you want. The method of exchange (e.g. sending a replacement after the return is received, simultaneous shipment, or settling any price difference) is agreed in the correspondence.

5. Faulty or incorrect goods
 If goods are defective, damaged or incorrect:
  - email info@swimbuy.ee as soon as possible
  - include the order number, a description and photos if possible
 If the issue is confirmed, we will offer a replacement, repair or refund. We cover return shipping costs.

6. Who pays for return shipping
 - Withdrawal / return at your request — the buyer
 - Our error or defective goods — SwimBuy

7. Refunds
 After we receive and inspect the goods, we refund to the same account used for payment (unless otherwise agreed) within 14 days. We may wait until the goods are received or you provide proof of shipment.
 If you return the entire order, we also refund the standard delivery cost in accordance with the Terms of Sale / consumer protection law.
